ROAD MAINTENANCE MANAGEMENT BOARD

Article 1. Position and functions
1. The Road Maintenance Management Board (hereinafter referred to as the Board) is a public service unit under the Department of Construction; has legal status, its own account and its own seal, arranged for use at each working facility, under the direct and comprehensive direction and management of the Department of Construction, and is responsible to the Director of the Department and the law in the process of performing its tasks.
2. The Road Maintenance Management Board performs the function of advising the Director of the Department of Construction on road management and maintenance and periodic road repair projects for national highways under its management and provincial roads under the Central Government's traffic economic career capital and the province's traffic economic career capital.
Article 2. Duties and powers
1. Building and managing technical data on exploitation and data on traffic infrastructure assets including: Construction records, completion records, monitoring and quality inspection records; maintenance records during exploitation, traffic accident history, vehicle counting data, essential infrastructure built in traffic safety corridors; monitoring and accounting for asset fluctuations.
2. Carry out road patrol tasks to monitor the exploitation and operation of traffic infrastructure systems; update traffic situations on the road system and update real-time traffic information into management software.
3. Monitor, inspect or coordinate inspection of relevant entities in compliance with traffic organization plans, traffic diversion, construction organization of works in operation or investment in construction of works belonging to traffic infrastructure assets.
4. Direct the handling of situations that arise that endanger traffic and construction safety, especially during natural disasters and floods.
5. Develop plans for exploitation and traffic organization on important traffic routes with high traffic volume; coordinate with competent agencies and organizations to organize traffic regulation according to approved exploitation plans.
6. Monitor to adjust and update the signaling system when there are changes; monitor accident situations, propose handling of black spots and high-risk spots causing accidents and traffic jams.
7. Organize and implement maintenance procedures for large, complex technical works according to the provisions of law on construction management and exploitation; develop annual maintenance plans.
8. Develop and propose an annual infrastructure maintenance plan for competent authorities to review and allocate funding for implementation.
9. Organize the pricing of public service products and carry out procedures for assigning plans, placing orders or bidding to select service providers for regular management and maintenance of the traffic system.
10. Inspection, supervision, acceptance, payment and settlement of contracts with the Department of Construction as the investor.
11. Manage the implementation of periodic and emergency repair project tasks for the transport infrastructure system invested by the Department of Construction in accordance with the provisions of law on investment in construction and repair of transport works.
12. Manage traffic construction investment projects invested by the Department of Construction or other projects assigned by competent authorities according to regulations.
13. Provide consulting services (project management consulting, bidding consulting, construction supervision consulting, survey supervision consulting, design consulting, appraisal consulting) for projects in accordance with the regulations and capacity of the unit.
14. Perform other tasks assigned or authorized by competent authorities or the Director of the Department of Construction in accordance with the provisions of law.
Article 3. Organizational structure and number of employees
1. Board of Directors: Director and no more than 03 Deputy Directors.
The Director is the head of the Board, responsible to the Director of the Department of Construction and the law for all activities of the Board.
The Deputy Director of the Board is the person who assists the Director of the Board in charge of a number of areas of work; is responsible to the Director of the Board and before the law for assigned tasks.
The appointment, dismissal, removal, resignation, commendation, discipline, rotation, implementation of regimes and policies for the positions of Director and Deputy Director of the Board shall be carried out according to the province's cadre management decentralization and regulations of law.
2. Functional rooms
- Planning and Synthesis Department;
- Management and maintenance department ;
The number of deputies of the departments under the Board shall comply with the provisions of Clause 3, Article 6 of Decree No. 120/2020/ND-CP dated October 7, 2020 of the Government regulating the establishment, reorganization, and dissolution of public service units and current legal provisions.
3. Number of employees
The number of employees of the Board is planned and proposed annually by the Board and approved by competent authorities.
The management, determination of job positions and number of employees; recruitment, arrangement, use and management of civil servants and employees of the unit must be based on the functions, tasks, workload, nature and characteristics, job positions, professional title standards, civil servant rank structure according to the province's cadre management hierarchy and regulations of law.
Article 4. Implementation
1. The Director of the Department of Construction shall preside over and coordinate with relevant agencies and units to implement this Decision and Project No. 38/DA-SXD dated July 7, 2025 of the Department of Construction on the establishment of the Road Maintenance Management Board under the Department of Construction.
2. The Director of the Road Maintenance Management Board is responsible for managing and using the seal in accordance with the provisions of law.
