CENTER FOR PLANNING AND CONSTRUCTION CONSULTATION

Article 1. Position and functions 

1. Location

The Center for Planning and Construction Consulting  (hereinafter referred to as the Center)  is a public service unit under the Department of Construction; has legal status, its own seal and account, is under the direct and comprehensive direction and management of the Department of Construction, and is responsible to the Director of the Department and the law in the process of performing its tasks .

The Center is a public service unit serving state management and providing public services, established under the authority of the Provincial People's Committee and is a public service unit that self-insures regular and investment expenditures.

2. Function

The Center's function is to carry out activities related to  urban and rural planning and construction consultancy to serve State management in the construction field. 

Article 2. Duties and powers

The tasks and powers of the Center under the Department of Construction are specifically prescribed as follows:

1.  Perform tasks serving state management in the field of urban and rural planning assigned by the Department of Construction or ordered by state agencies, including:

a) Research and propose policies and mechanisms for urban and rural development, technical infrastructure and environmental development, and other types of architectural works;

b) Research, build a database system, methodology, systematize standards, regulations on urban and rural planning, technical infrastructure in the country and in the world to propose the selection of appropriate methods to apply in the province, ensuring feasibility and rationality according to regions;

c) Research, propose and participate in drafting legal documents on urban and rural planning;

d) Study national urban and rural system planning projects, urban and rural planning components in national-level plans and other plans to coordinate and participate in reviewing urban and rural plans in the province;

e) Research and propose the integration of environmental protection planning, response to climate change and rising sea levels in the process of urban and rural planning.

2.  Preside over or coordinate the organization of scientific research activities, application of scientific and technical advances, development and transfer of technology in the fields of urban and rural planning, urban development, architecture and other related construction fields.

3.  Investigate, survey, collect, synthesize, build, manage, store and provide information and databases in the fields of urban and rural planning, urban planning, development and architecture. Research the application of geographic information systems (GIS) and building information models (BIM) in the fields of urban and rural planning, urban development, architecture and other related planning fields to propose solutions for application and management in the province.

4.  Carry out consulting activities and technical services in the fields of construction, architecture, urban and rural planning, including: Geological survey, topographic survey, measurement of the current status of construction works; planning tasks, urban and rural planning; establishing and examining construction investment projects; establishing and examining construction design documents to be implemented after the basic design and construction estimates of construction works; bidding consultancy; construction supervision of construction and traffic works; project management according to the capacity of the unit or joint venture in accordance with the provisions of law to implement; consulting and reviewing in the field of construction.

5.  Organize exhibitions, events, displays and introductions in the fields of urban and rural planning, architecture and other fields of the construction industry in the province.

Article 3. Organizational structure 

1. The Center's apparatus includes: 

a) The Center's leadership includes: Director and no more than 02 Deputy Directors.

The Center Director manages all activities of the Center. Responsible to the Director of the Department of Construction, the Management Board and the law in performing assigned duties and tasks.

The Deputy Director assists the Director, is assigned to be in charge of a number
of areas of work, is responsible to the Director and jointly responsible
to superiors and before the law for the assigned areas of work.

The appointment, reappointment, dismissal, transfer, rotation, commendation, discipline, retirement, resignation and implementation of regimes and policies for the Director and Deputy Directors of the Center shall comply with the provisions of law and the decentralization of the  Provincial People's Committee  on personnel management.

b) Professional departments, including 03 departments,  each department has a Head of Department, 01 Deputy Head of Department and professional staff,  advising the Director of the Center :

- Administration and General Department: Advising on administrative management - human resource organization, economic and financial accounting. Performing the function of controlling and managing the unit's finances according to regulations.

- Construction Planning Consulting Department:  Organizes and implements consulting on the establishment of all types of urban and rural planning;  establishes investment projects, designs and implements construction after basic design;  conducts geological surveys, topographic surveys, measures the current status of construction works, etc. according to the unit's capacity or in the form of joint ventures according to the provisions of law; participates in consulting and criticism activities, scientific research, and architectural design competitions. 

- Construction Technical Consulting Department:  Organizes the implementation of construction investment project appraisal, appraisal of construction design documents implemented after basic design and construction and traffic project estimates; surveys and evaluates the current status of construction works;  prepares bidding documents; supervises construction works, consults on construction  investment project management,... according to the unit's capacity or in the form of joint ventures according to the provisions of law; participates in consulting and criticism activities, scientific research, and construction technical solutions.

2.  Recruiting, employing and managing employees at the Center

a) Recruitment, employment, salary increase, rank transfer, rank appointment, job title change, transfer, reward, discipline, retirement and implementation of other regimes and policies for employees working in the Center shall comply with current laws;

b) The assignment of work to civil servants and labor contracts (according to Decree No. 111/2022/ND-CP) of the Center must be based on job positions, civil servant title standards, qualities, abilities, and strengths, ensuring compliance with legal regulations;

c) Officials and employees under labor contracts according to Decree No. 111/2022/ND-CP of the Center are responsible to the Director of the Department of Construction, the Director of the Center, the department leaders and the law for the assigned tasks.

3. Number of employees: 

a) The number of employees of the Center is assigned based on the Job Position Project, linked to functions, tasks, and powers and is within the total number of employees of the Department of Construction assigned or approved by competent authorities.

b) Based on the assigned positions, functions and tasks, the Director of the Center proposes that the Director of the Department of Construction decide to assign a sufficient number of employees to perform the functions and tasks well.

Article 4. Financial mechanism

The financial mechanism of the Center is implemented according to the provisions of Decree No.  60/2021/ND-CP  dated June 21, 2021 of the Government stipulating the financial autonomy mechanism of public service units  and relevant legal provisions. 

Article 5. Asset management and use

The Center is responsible for managing state assets according to current regulations on state asset management at public service units.

For fixed assets, the Center must depreciate fixed assets according to the regime applicable to state agencies, public service units and organizations using the state budget according to current regulations.

Article 6. Implementation

The Director of the Department of Construction shall preside over and coordinate with relevant agencies and units to implement this Decision.
